Family Courts almost always issue spousal and child support awards, and often orders for attorney fees ( Family Code section 6344 ), when legally proper and the evidence justifies it.
Child Custody and Visitation
Physical custody has to do with the time that a child is under the supervision and control of a parent, and extends to activities outside the home such as school, daycare, or activities. The term expresses who's "watch" it is. Contrary to what most people assume, the labels that attach to different concepts of custody and visitation do not of themselves establish the practical day-to-day timeshare. For instance, agreeing to joint physical custody does not of itself mean that the kids are with one parent one-half the time. It is not uncommon for the court to award joint physical custody, but the lower time parent may only have the children on alternating weekends.

In the 1980s, divorce reached the status of what family scientists call a "normative event," which means it was accepted a common part of the life cycle experience for most Americans. Divorce ends 50 percent of most first marriages, and 61 to 65% of second marriages. Statistically, the divorce cycle consists of marriage, divorce, remarriage, and re-divorce. This is one reason why premarital agreements, or prenups, are increasingly common and important.

Legal Separation
Physical and legal separation are two distinct and mostly unrelated concepts in California family law. Physical separation describes the end of the relationship, as established by way of concurrent intent and conduct. Physical separation is a key issue in divorce because California community property law presumes that all property acquired between the date of marriage and separation is joint property. This is because by operation of law the time, skill, and efforts of each spouse - and the goodies (or debts) that are accumulated with it - are community property, with each spouse owning one-half of an undivided whole. This is set forth in Family Code section 760, and is known as the "time of acquisition" rule. It is not the date of a divorce decree, or the termination of marital status, that ends the on-going creation of CP. For instance, your marriage cannot be dissolved earlier than 6 months from the date of service of a summons and petition for dissolution. But, obviously, you would not want your soon to be ex to continue to share in your earnings if you'd decided to end the marriage 6 months and a day before.
Annulment
Family Code § 4301 establishes a statutory duty of support between married couples and registered domestic partners, but it requires that a court first order support for this support obligation to be enforceable. Support orders are obtained by stipulation and agreement, or through contested support hearings. Spousal support is generally not available in annulments unless at one party can establish a "putative spouse" status.

Criminal Defense
In 1943, Arnold was appointed to become a judge of the United States Court of Appeals for the District of Columbia Circuit, succeeding Wiley B. Rutledge, who had been promoted to the U.S. Supreme Court. He was "kicked upstairs" by FDR to the Court of Appeals in order to get him out of the Antitrust division. Although it had some responsibility for review of decisions by federal administrative agencies, during Arnold's tenure the court's primary role was reviewing decisions of local trial courts involving routine civil and criminal matters arising in Washington, D.C. Thurman's grandfather was not happy during his time on the court, resigning after two years on the bench. In explaining his decision, he notably remarked he "would rather be speaking to damn fools than listening to damn fools."

During my settlement agreement I could not obtain an end date for support. Documented domestic violence, crimes against me (the payor), forgery, identity theft, cohabitation, documented perjury, all without consequence. All because it was a marriage of long duration 29 +. A long marriage is no remedy to violating Fiduciary Duties which can be addressed.
Restraining Order
California Family Courts are empowered to prohibit the following activities by enjoining them through domestic violence restraining orders: "molesting, attacking, striking, threatening, sexually assaulting, battering, harassing, telephoning, including but not limited to, annoying telephone calls..., destroying personal property, contacting either directly or indirectly, by mail or otherwise, coming within a specified distance of, or disturbing the peace of the other party, and, in the discretion of the court, on a showing a good cause, of other named family, or household members." FC section 6320. Hence, each of these activities may constitute the abuse that justifies the issuance of emergency and permanent orders. There is no requirement of a injury and many times the abuse is not that direct. Often the abuser abuses indirectly and destroys personal property, or isolates or humiliates a victim, or controls his or her access to friends, relatives, or finances.

Estate Planning
If your husband owned the house before marriage, but added your name to title during marriage for any reason (estate planning, refinances), then a transmutation has occurred and the house is now community property, subject to a Family Code section 2640 reimbursement to him for the equity he had in the property as of the date of the transmutation.

More and more people wish to remarry or marry later in life when they already have children, or property and assets to responsibly manage and protect. Some are concerned about liability for credit cards and foreclosure or other debts and property from prior relationships and don't want to impose them upon their new mate. Many have been burned by the divorce process, or watched their parents or others they know have horrific divorce experiences. Others want a simpler and less expensive road-map for resolving differences if a relationship fails rather than the chaos and expense that litigation engenders. Still other people recognize that planning for the future at whatever age provides freedom and flexibility, and even report that they stay together because they have the security of a clear understanding of their rights and obligations.
Tax Law
There are many reasons why spouses may wish to separate their affairs and yet remain legally married or as domestic partners. A couple may wish to seek a legal separation for religious or personal reasons, so they may remain legally married or as domestic partners while living separate lives. For married couples, one argument for legal separation is that there are significant health insurance consequences upon divorce: Under federal COBRA legislation health insurance coverage is lost soon (between 18 to 36 months) after marital status is terminated. Other economic consequences involve tax planning, or estate planning. In a compassionate breakup where a new marriage is not expected, legal separation can be a beneficial alternative to divorce in order to preserve certain benefits and protections to both persons.
